Work Terms of Service

1. Upon Initial Commission, the Client should present the artist with a clear visual reference or a highly detailed vision for the artwork will be discussed.2. The final quote from the artist will depend upon the complexity of the artwork in question, which may raise the price. Advertised prices are NOT final and may rise depending on various factors of complexity in design, edits, assets, etc.3. An initial conceptualized idea will be sent to the Client for revision. After final approval, in-progress updates will be sent at the discretion of the artist. The Client may request more in progress updates but compliance is not guaranteed.4. The Artist reserves the right to deny any commission at any time without a given reason.5. The artist reserves the right to cancel the commission at any time in progress and issue a refund due to any of the following reasons:
a. Unclear and ineffective communication on behalf of the Client.
b. Rude, uncooperative or obscene behavior towards the Artist from the Client.
c. Lack of communication on behalf of the Client.
i. Time spans larger than 1 week after a check-in without reason are considered lack of communication
ii. Reasons given for lack of communication should be clear and the Client cannot expect the Artist continue constant work without communication
6. All discussions of the commission and transactions will be done preferably through email at [email protected]. Discussions through notes, or messages through chat programs are considered reliable so long as the commissioner responds in a timely manner.
a. The Artist reserves all rights not to respond to any commission-related inquiries outside of the listed email.
7. The Artist reserves the right to determine their own working hours. Constant pestering of the Artist for work on the commission outside of their working hours may cause your commission to be cancelled under term 5.b.
a. The Artist’s working hours may vary upon their current life situation.
b. The Artist reserves the right to take weekends off from working on commissions.
c. The Artist does work under time restraints occasionally and if the Commissioner requests it to be done by a certain day, then fees may apply. Commissions are done by queue, otherwise.
8. The client may request free changes to any presented image when it is in concept form. A complete re-conceptualization of the image will be allowed a total of one time. In further stages, adjustments may be made to the current stage of progress. (colors, simple effects, ETC.). Any larger changes at later stages of the commission will accrue a fee deemed appropriate by the artist based on how long it will take to correct perceived error.
a. In the case of the Artist missing a detail or misunderstanding the Client, the Client may request a second free re-concept or a change in the piece itself.
9. Critiques, redlining, and other forms of suggesting changes to the commissioned piece from the Client are welcome. However, the Artist reserves all right to deny these suggestions if they deem them unfit.10. The Artist reserves all right to display the commissioned piece through any personal website, galley, journal, etc. The Artist reserves all right to use the piece in the future for examples of their own work.
a. Commissioned pieces will always be uploaded and displayed. Requests not to upload the image may be denied.
b. Delay upon uploading the image due to events such as birthdays, holidays, or other festivities may involve gifting the art piece are entirely fine so long as the upload date is agreed upon by the Artist and Client.
11. The client has the right to reupload the commissioned image in their personal galleries, profiles, or other websites as long as the use of the image follows the following guidelines.
a. The commissioned work is not used for commercial purposes without negotiation and proper fee from the artist.
b. The client does not claim complete ownership of the commissioned work.
c. The client credits the Artist and links to at least one of their profiles in a description of the reuploaded work.
d. If the commissioned work is for more than one person besides the Client, the additional person(s) are allowed to upload the work as well.
12. The Client cannot alter the original piece without express permission from the Artist.13. The commissioned work will always remain the intellectual property of the Artist. The Client retains all right to their creation(s) if applicable (e.g. VRChat avatars, worlds, ETC.).14. Acceptance of a commission from the Client by the Artist does not give the Client any right to add the Artist to the Client’s friend list or contact list in any program or website.
a. Though don’t be afraid to ask!

Payment & Reunds

1. Payment is only accepted through paypal in USD. Payment in other forms is not valid for the moment.2. Payment will be done in stages, Once first payment is given, the Artist will agree with the Client for a scheduled session in a queue system. The queue is always in chronological order of payment received, not commission requested.
a. The pricing method will be separated into two main payments, an initial amount established by the Artist for their services (photography sessions, use of their expertise, time spent in the piece, ETC.) as well as an added charge per all the edits made for the final artwork, this because the final price won’t be known until the piece is finished.
b. After the artwork is finished the Client must give the second payment before the Artist presents the final piece, failure to do so may result in a cancellation under term 5.b.
The Artist will keep all the rights to the artwork and a refund will be null and void.
3. The Client may only request refunds before work begins, during the conceptualization stage, or during the photography stage. Any requests for refunds after are null and void.
a. Refunds before work begins will be done in full.
b. Refunds during the conceptualization stage will be at 75% of the value of the original payment.
c. Refunds during the photography stage will be at 50% of the original payment.
d. Refunds due to the Artist cancelling will always be at 100% value unless otherwise states in these terms.
4. Each additional image per batch will add to the price depending on how many there are in the batch.
a. Any additions to the batch of fully edited and rendered pieces will be decided by the Artist.
i. Every additional piece will start at a base price set by the Artist, this will, in most cases, be 50% of the initial payment unless other fees apply.
ii. After the additional artwork(s) have been finished, the second payment will include all edits, changes and rendering done to every artwork worked on as stated under term 2.a under Payment and Refunds.

Commissioning my work

If you wish to request a commission from me, please email me at [email protected] OR message me on discord at kat.dreams.I receive payments through paypal HEREIf you feel uncomfortable with that method of payment, I require partial payment that is non refundable after the commission has been started. With this being said, I tell any and every customer, if in the event where I do not get paid in full, or at all, they get black listed, blasted, and the artwork will be used for my own enjoyment, let’s be good sports alright.By commissioning the Artist, the Client confirms that they have read, understood, and agreed to all of the above terms. The Client understands that violating any of these terms may cause immediate cancellation and refunding of their commission.
I charge taxes for your commission, just like any other product you would buy. 16%
